Insurance coverage for all FDA-approved birth control passes PA House

HARRISBURG, June 3 – State Rep. Leanne Krueger, D-Delaware, today announced her bill, the Contraceptive Access for All Act, passed the Pennsylvania House of Representatives with a bipartisan vote of 116-87. She has been working on this legislation since 2017.
House Bill 1140 requires all insurance policies available in Pennsylvania to cover all FDA-approved contraceptive medicines and devices without cost-sharing, including all emergency and over-the-counter contraceptives.
“Since the overturn of Roe v. Wade in 2020, we’ve seen more and more states restrict women’s healthcare by limiting their access to research-backed contraceptives and reproductive healthcare,” said Krueger. “Contraceptive use goes beyond the ability to control whether or when a woman gets pregnant. A significant percentage of contraceptive users in the United States use contraception for a reason completely unrelated to preventing pregnancy, such as treating a medical condition like endometriosis.
“There are currently no protections in state law for contraceptive access, and it is more urgent than ever that we need to make sure that Pennsylvanians have access to the medications they need.”
In addition to insurance requirements, the bill would create a new statewide standing order for contraceptives, issued by the Pennsylvania secretary of health or physician general, for all FDA-approved over-the-counter emergency contraceptive drugs and FDA-approved over-the-counter contraceptive drugs.
The Contraceptive for All Act passed the House last session with a bipartisan vote of 133-69, but failed to pass the Senate. Today it passed the House with bipartisan support and heads to the Senate again.
“I look to my peers in the Senate for their support in getting this bill signed into law,” said Krueger. “Contraception is healthcare, plain and simple, and regardless of why a woman needs or wants to use it, that should be her choice. Let’s ensure that all Pennsylvanians have access to contraception when they need it.”
