Borowski bill again earns bipartisan support in effort to protect PA health services & facilities from corporate greed

HARRISBURG, June 10 – The Pennsylvania House passed legislation today that aims to preserve the public’s access to healthcare by protecting the commonwealth’s healthcare services and facilities from unchecked corporate ownership in the healthcare industry, voting 121-82 to approve H.B. 1460 sponsored by Rep. Lisa Borowski, D-Delaware.
The legislation comes in direct response to the devastating closure of Crozer Health System, which underwent systematic service cuts and facility closures after California-based private equity firm Prospect Medical Holdings purchased it in 2016. With the recent shuttering of Crozer’s two remaining hospitals, hundreds of thousands of Delaware County residents are without access to local medical care – with many now up to an hour away from an emergency room – and thousands of southeast PA residents are now without jobs.
“If we can’t come together as a legislature to get this protection in place for the people we represent, the message will be clear to Pennsylvanians: ‘Your government does not value your basic needs,’” Borowski said. “This is a measure that provides a commonsense, straightforward solution to an issue with undeniable impact. Crozer Health is gone, with a healthcare desert in its place, because we didn’t have a law like this on the books.”
Borowski first introduced the measure during the 2023-24 legislative session. It passed in the House with bipartisan support, but Senate leadership failed to bring it up for a full vote by the chamber.
“I’m proud to see the House pass H.B. 1460 and move us one step closer to protecting Pennsylvania’s healthcare systems from corporate greed,” Sen. Tim Kearney, D-Delaware, said. “Since 2022, the Delaware County House & Senate Legislative Delegations have fought tirelessly for these safeguards, and this is a big win for our communities. We’ll continue that fight in the Senate to make sure no more hospitals in PA fall victim to private equity at the expense of patients, workers, and access to care.”
House Bill 1460 – as well as its companion bill in the Senate, S.B. 322, sponsored by Kearney (who first introduced the measure in his chamber in 2022) – would:
- Grant the Office of the Attorney General expanded authority to review mergers, acquisitions and other major financial transactions involving health systems.
- Prohibit healthcare sale-leaseback agreements by private equity firms.
- Require healthcare entities to submit detailed financial and operational disclosures before completing major transactions.
- Allow deals to be evaluated on a case-by-case basis.
“My question for any lawmaker who opposes this legislation is, ‘Why did you choose a career in public service if you are going to prioritize growing the wealth of private equity firm owners over the protecting the health of the people you represent?’” Borowski said.
